All packages are flat-fee. USPTO government filing fees (currently $350 per class) are paid separately. Not sure which is right for you? Ask a specialist.
Most applications take roughly 12 to 18 months from filing to registration, depending on USPTO examination timelines and whether an Office Action is issued. Once registered, your nationwide rights date back to your filing date, which is why filing early matters.
The USPTO base application fee is currently $350 per class of goods or services. Surcharges can apply for incomplete information or custom descriptions that fall outside the USPTO's pre-approved ID Manual, part of why careful drafting matters. Government fees are paid to the USPTO and are separate from Allot Mark's service fee.
We strongly recommend it. The most common reason for refusal is a likelihood of confusion with an existing mark, and USPTO fees are not refunded if an application is refused. A comprehensive search reveals risks early, when changing course costs the least.
You may use ™ with any mark you claim as your own, whether or not it is registered. The ® symbol may only be used once the USPTO has issued a federal registration, and only for the goods and services listed in it.
A standard-character (word) mark protects your name in any font, style or color, which is usually the broadest protection. A design mark protects your logo artwork specifically. Many brands file the name first and add the logo as the design settles. We will help you decide.
An Office Action is a letter from the examining attorney explaining a refusal or a requirement. You generally have three months to respond, with one three-month extension available for a fee. We explain what it means, outline your options and track the deadline for you.
Yes. Anyone who uses or intends to use a mark in U.S. commerce can apply. Applicants domiciled outside the United States must be represented by an attorney licensed in the U.S., which we coordinate as part of our service.
